Chapter 1: General Provisions

Article 1: Definition of Terms

In these Terms of Use for Yamaguchi Prefecture "Infra Marugoto Management" (hereinafter referred to as "these Terms"), the following terms shall have the meanings set forth below:

Infra Marugoto Management The Civil Engineering and Architecture Department of Yamaguchi Prefecture promotes digitalization and data utilization, enhancing productivity in the construction industry, improving infrastructure maintenance efficiency, and effectively promoting its appeal to attract new workers and increase companies engaging in DX (digital transformation). This initiative aims to overcome labor shortages and other challenges while ensuring a safer and more enriched life for residents. "Infra Marugoto Management" integrates and openly shares data related to facility maintenance—such as specifications and inspection results for road facilities and river management facilities—across multiple business systems, facilitating data linkage and utilization beyond the boundaries of national,prefectural, municipal, and private sectors.
Operational Administrator The entity responsible for operating and managing "Infra Marugoto Management" (Yamaguchi Prefecture Civil Engineering and Architecture Department, Technical Management Division, Construction DX Promotion Team).
This Service Services provided through "Infra Marugoto Management" by the Operational Administrator.
Service User A person who utilizes the services provided by "Infra Marugoto Management" in accordance with these Terms.
Data ProviderData Provider A person who provides data to Service Users via "Infra Marugoto Management" in accordance with these Terms.
Provided Data Data supplied by the Data Provider to Service Users via "Infra Marugoto Management."
Content Information provided through this service, including data, images, text, user manuals, etc.
Creative Commons 4.0 International (CC 4.0 License) A set of six licenses provided by the international non-profit organization Creative Commons that stipulate terms for commercial use, modification, and reproduction of copyrighted works.
Creative Commons 4.0 International - Attribution (CC BY 4.0 License) A specific CC 4.0 license that allows commercial use, reproduction, redistribution, and modification of copyrighted works, provided that proper attribution is given.
Open Data Commons Open Database License (ODbL) A license provided by the international non-profit organization Open Data Commons that stipulates terms for the sharing, modification, and utilization of copyrighted works.

Article 2: Purpose and Application

  1. These Terms define the conditions for using this service.
  2. Unless otherwise specified, references to legal regulations in these Terms refer to Japanese law.

Article 3: Amendments to These Terms

  1. The Operational Administrator may amend these Terms without prior notice.
  2. The revised Terms shall take effect from the time they are publicly announced.
  3. When these Terms are changed, the Operational Administrator shall notify Service Users by posting the revised Terms on the website of this service.
  4. By continuing to use the service after the notification in the preceding paragraph, Service Users shall be deemed to have agreed to the amended Terms.

Chapter 2: Use of This Service

Article 4: Agreement to These Terms

  1. Service Users shall carefully read and agree to these Terms before using this service.
  2. By using this service, Service Users are deemed to have agreed to these Terms.

Article 5: Responsibilities of Service Users

  1. Service Users shall use this service at their own discretion and responsibility and appropriately manage the following information arising from their use of this service:

    1. Electronic files downloaded from this service
    2. Emails received in connection with the use of this service
    3. Information created or obtained by Service Users in connection with this service
  2. Users who wish to use APIs through this service must submit an application by entering the required information on the application page of the Operational Administrator’s website. The Operational Administrator will grant permissions on an individual basis and issue accounts. Applicants must properly manage their issued accounts.
  3. The Operational Administrator reserves the right to reject applications based on its own review process.
  4. If an application is rejected, the Operational Administrator shall promptly notify the applicant but shall not be obligated to disclose the reasons for rejection.

Article 6: Prohibited Activities

Service Users shall not engage in the following activities when using this service (including use of secondary derivatives):

  1. Using or attempting to use this service for purposes that violate these Terms.
  2. Using or attempting to use this service for purposes contrary to public order and morals, such as sending viruses or unauthorized access.
  3. Conducting actions that violate applicable laws and regulations.
  4. Engaging in any other activities that hinder or may hinder the management and operation of this service.

Article 7: Use by Third Parties

Service Users shall not allow third parties to use all or part of this service, whether for compensation or not. This includes lending IDs, accounts, or passwords, or incorporating this service into another service.

Article 8: Use of Data, etc.

  1. Unless otherwise specified in applicable laws, contracts, regulations, or licenses (hereinafter referred to as "Superior Terms"), Service Users may use content under the Creative Commons Attribution 4.0 International (CC BY 4.0) license. In such cases, the source must be credited as "Infra Marugoto Management" or "Infra Marugoto Management" along with the Data Provider.
  2. Some content is subject to usage conditions specified by "higher-level regulations, etc." The provisions of the preceding paragraph do not apply to content for which usage conditions are stipulated by relevant laws, higher-level regulations, etc. For content governed by higher-level regulations, the presence of usage conditions may be explicitly stated or indirectly implied through source citations or other indications. However, in some cases, specific usage conditions may not be clearly identified or explicitly stated. Users are responsible for verifying the applicable conditions when using such content.
  3. All copyrights and other rights to content belong to the respective rights holders. The Operational Administrator does not transfer or grant any rights beyond what is specified in these Terms.
  4. If a Service User exceeds the permitted scope of use or infringes upon the rights of content, they shall be liable for any damages caused to the Operational Administrator.

Article 9: Agreement to Higher-Level Terms

  1. Data users are required to confirm and comply with any higher-level terms that apply to the content. The provisions of such higher-level terms shall apply to this service. If a user violates these higher-level terms, they shall bear responsibility, and any damages incurred by the service administrator as a result of such violation shall be compensated by the user.
  2. Unless otherwise specifically provided in these Terms, if there are contradictions or conflicts between these Terms and higher-level terms, the higher-level terms shall prevail.

Article 10: Data Provision

  1. The data administrator shall present the terms of use of the provided data to the service users.
  2. The data administrator shall include information on the freshness, granularity, accuracy, and reliability of the provided data in the metadata and present it to the service users.
  3. The data administrator permits the use of data and metadata provided through this service under the Creative Commons Attribution 4.0 International (CC BY 4.0) license.

Article 11: Intellectual Property Rights

  1. The intellectual property rights, including copyrights and moral rights, related to programs and other works (including these Terms and service manuals) concerning this service, as well as any included know-how, belong to the service administrator.
  2. Permission for the use of this service under the terms of a usage contract is limited to the necessary scope for the use of the service and does not grant any license for the intellectual property rights of the service administrator or licensors.

Article 12: Protection of Personal Information

The service administrator shall appropriately handle the personal information of service users in accordance with this site's "Privacy Policy."

Chapter 3: Suspension of Service Provision

Article 13: Suspension of Service

  1. The service administrator may suspend or restrict the use of this service without prior notice if any unavoidable circumstances arise, such as natural disasters, emergencies, major failures of the service, or other compelling reasons.
  2. The service administrator may restrict the use of this service without prior notice if there is a significant concentration of access to the service.
  3. The service administrator shall notify users of the suspension or restriction of the service on the service website.
  4. If the service is suspended or restricted as stipulated in paragraphs 1 and 2, the service administrator shall not be liable for any damages incurred by the users.

Article 14: Termination of Service

  1. The service administrator may terminate the service by announcing the termination on the service website.
  2. If the service is terminated as stipulated in paragraph 1, the service administrator shall not be liable for any damages incurred by the users.

Chapter 4: Disclaimers

Article 15: No Warranty and Disclaimer

  1. The service administrator shall not be responsible for any damages suffered by service users or third parties due to the use or inability to use this service.
  2. The service administrator shall not be responsible for any damages suffered by service users or third parties due to the suspension, interruption, or restriction of the service, or network failures.
  3. The service administrator shall not be responsible for any damages caused by malware infections occurring during the use of this service.

Chapter 5: Miscellaneous Provisions

Article 16: Service Operation Delegation

The service administrator may delegate all or part of the operations necessary for the provision of this service to third parties. In such cases, the service administrator shall impose obligations equivalent to those stipulated in these Terms on the contractors.

Article 17: Governing Law and Jurisdiction

The formation, interpretation, and execution of these Terms shall be governed by the laws of Japan.All disputes arising between the service administrator (or its contractors) and service users in connection with the use of this service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the service administrator’s location (as of the date of enactment, the Yamaguchi District Court) as the agreed exclusive court of first instance.

Supplementary Provisions

Article 1: Effective Date

These Terms shall take effect from March 24, 2025.
